"LEGAL
AID"
FitzPatricks
regret that despite having achieved all the necessary quality
standards and more besides, they have not been able to reach
agreement with the Community Legal Service and do not therefore
undertake publicly funded work.
Property
Contentious
issues may arise from owning or occupying land and may be solved with legal advice.
Family
Help is available
on many issues including co-habitation, divorce, finance and children.
Employment
Assistance
is offered to both employers and employees on matters surrounding
the workplace.
Personal
Injury
We advise
concerning injuries at work, slipping or tripping cases, road
traffic accidents or any other incidents resulting in pain, suffering,
loss of earnings.
Small
Claims
For disputes
where the sum claimed is under £5,000 (£1,000 for personal injury
and housing disrepair) then any proceedings will be referred to
a small claims court (arbitration). This is a more informal
procedure than a normal County Court action and the Court has
limited power to order costs. You will be expected to bear
your own legal costs win or lose.
Debt
Recovery
- Letter
before action
- Pre-action
protocol
- Claim
- Judgement
- Enforcement
- Bankruptcy/winding
up
Whatever stage
of the proceedings reached we can offer assistance to help recover
monies due. Unfortunately, we cannot act in the administration
of bankrupt or insolvent estates, or winding up companies.
These matters are handled only by licensed insolvency
practitioners. We can only advise in any of these cases
about preliminary issues.
Consumer
Problems
Disputes relating
to goods or services sold or supplied come within consumer protection
legislation of which both seller/supplier and consumer should be aware.
We advise on these issues.
Contract
Disputes
- Contracts
of employment
- Terms and
conditions of business
- Property
contracts
- Consumer
contracts
- Other agreements
Whether
contracts are written
or verbal, disputes can be settled through negotiations,
alternative dispute resolution, arbitration or, ultimately, Court proceedings.
Negligence
Issues
- Are you
owed/do you owe a duty of care from or to another?
- Has this
duty of care been breached?
- Is there
resultant damage?
If all three
elements are established then negligence may arise and legal issues
will need to be investigated. The question of damages may
then need to be considered.
